Can a board member give permission for an outbuilding?
The answer is NO! Burning Tree Master Association Board
members do not have any authority, nor have ever had to violate Covenants by granting
permission for an outbuilding, nor would they want to as the Covenants
state:
2. If the parties hereto or any of them or their heirs or assigns shall violate or attempt to violate any of the covenants herein, it shall be lawful for any other person or persons owning any real property situated in said development or subdivision, to prosecute any proceedings at law or in equity against the person or persons violating or attempting to violate any such covenants and either prevent him from so doing to secure damages or other dues for such violations.
Thus,
giving permission to violate the covenants by putting up an outbuilding, may cause the person (or board member) legal trouble.
Yes, everyone is aware that a certain past career board President has several tacky outbuildings in her backyard....all put up when she got herself in as President.
Further,
the Burning Tree Master Association board of directors has no authority whatsoever, over anything
but the common areas (pool, tennis courts, mowing, etc.)
